Calcutta High Court Grants Interim Bail to Influencer Sharmistha Panoli Amid Religious Sentiment Controversy

The Calcutta High Court has granted interim bail to social media influencer and law student Sharmistha Panoli, who was recently arrested for allegedly posting a controversial video that was said to have hurt religious sentiments. The 22-year-old was taken into custody by Kolkata Police from Gurugram, Haryana, on May 30, following widespread backlash over her remarks made in the context of Operation Sindoor.

Operation Sindoor was a military response to the Pahalgam terror attack, and Sharmistha's video—which reportedly criticized Bollywood actors for their silence on the issue—sparked outrage online. Several complaints were filed alleging that her content promoted communal hatred. Although she deleted the video and issued a public apology, her arrest triggered a heated debate on the balance between freedom of speech and responsible communication in a diverse society.

Initially, the Calcutta High Court had rejected her bail plea. Justice Partha Sarathi Chatterjee, while delivering the earlier verdict, emphasized that the right to freedom of speech cannot be used to hurt others. “Our country is diverse, with people of various castes, creeds, and religions. One must be cautious when exercising freedom of expression,” he remarked.

However, the court later reconsidered her bail application and granted interim relief with certain conditions. Sharmistha was released on furnishing a bail bond of ₹10,000 and was asked to surrender her passport. The court also directed her not to leave the country without prior permission and to fully cooperate with the ongoing investigation. Given the threats she received post-viral outrage, she has also been provided police protection.

Her arrest has ignited political controversy in West Bengal, with the Opposition Bharatiya Janata Party (BJP) accusing the state authorities of selective action and undue haste. According to them, the arrest was politically motivated and an example of the state machinery targeting dissenting voices under the guise of communal sensitivity.

Following her release from Alipore Women’s Correctional Home, Sharmistha has decided to step away from social media for a while. Her father confirmed this move, stating that she wants time to reflect on the entire episode and its consequences. During her custody, she also faced several health challenges. She suffers from ADHD and kidney stones, and her family claimed that she was unable to access her medications due to the loss of her prescriptions. In addition to her health issues, she missed important law examinations, which may affect her graduation timeline.

The case has now been referred to a regular bench of the Calcutta High Court for further hearing. While the investigation continues, this incident has sparked a wider public discussion about the responsibilities of influencers, the interpretation of freedom of expression, and the need for a balanced legal approach when it comes to controversial online content. Sharmistha Panoli’s situation stands as a complex example of the challenges faced in a digital age where opinions, outrage, and justice often collide in real-time.
